COMPETITION TERMS AND CONDITIONS

Please read these Terms and Conditions carefully and ensure that you understand them before entering into any of our Competitions as they are applicable to every Competition on our Website.

1.

The Promoter

The promoter is: Victri Ltd (“Victri” or “Promoter”), a Company registered in England and Wales with Company number 15600183 of Unit A, Angel Business Centre, 1 Luton Road, Toddington, Dunstable, Bedfordshire, England, LU5 6DE.

The Competition

2.1
These Terms and Conditions apply to all Competition listed on the Promoter’s website at victri.co.uk (“Website”).
2.2
The Promoter’s Website is a Competition website, which runs both free and pay- to-enter Competitions to be drawn live (“Draw Competitions”) on Promoters social channels and other media networks where applicable. Participants shall obtain a random chance to win a prize during the live draws. Promoter may occasionally promote instant win competitions (“Instant Win Competitions”) and offer prizes that include travel, experiences, gift cards, vehicles, vouchers and lots more on the Website. “Competition” under this Terms and Conditions refers to both Instant Win Competitions and Draw Competitions.
2.3
There may be additional rules applicable to use of Promoter’s website such as Terms of Use, Acceptable Use Policy, Cookie Policy, Privacy Policy and also rules in relation to specific Competitions as they are listed on the Promoter’s Website. In the event of any conflict between these Terms and Conditions and any Competition listed on the Website, advertisement or other materials used in the marketing of a Competition, these Terms and Conditions shall govern.
2.4
By submitting an entry into any of the Competitions, you are agreeing to accept and be bound by these Terms and Conditions. If you have any questions, please contact the Promoter at [email protected] Please note that the Promoter reserves the right to refuse entry or refuse to award a prize to anyone who is in breach of these Terms and Conditions.
3.

How to enter

3.1
There are two routes to enter a Competition on our Website; Online Route and Postal Route.
3.2
To enter a Competition, you will be required to submit an email address and if applicable answer some questions including knowledge-based questions, problem-solving questions or complete simple multichoice questions (“Competition Questions”).
3.3
An entry fee is payable each time a person (“Entrant”) enters a Competition through the Online Route on the Website alternatively an Entrant can enter free through the Postal Route as outlined below.
3.4
The Promoter’s Website also offers spend cap that Entrants can set themselves. You can set a limit for how much is spent on services. Spend Caps are free and optional. Support is available at [email protected]
3.5
The Competition will run from and include the date it is published (the "Opening Date") to the dated stated for its closure (the "Closing Date") inclusive. All times and dates stated on the Website with regards to the Competition are the times and dates in London, England.
3.6
The Promoter reserves the right to change or correct times, dates or information of a Competition if circumstances permit and not to the detriment of any Entrant if possible. Any such change or correction will be duly communicated.
3.7
All Competition entries must be received by the Promoter no later than the stated time on the Closing Date. All Competition entries received after the Closing Date maybe disqualified and will not be refunded. Online entries will be received instantly.
3.8
Promoter will not be responsible for any submission errors caused by human or mechanical means, nor will Promoter be responsible for lost, late, illegible, incomplete, invalid, unintelligible, misdirected, technically corrupted entries all of which are void and ineligible to win. Also, Promoter is not responsible for any telephone, electronic, hardware, software, network, Internet, or computer malfunctions or failures.
3.9
To Enter a Competition;

Online Route: You will be required to

(a) go to the Website and view the Competitions available. Choose the Competition you wish to participate in and answer any Competition Questions with regards to the Competition;

(b) select the number of entries then proceed to checkout;

(c) then enter your email address to log in or register;

(d) read and accept Promoter’s Competition Terms and Conditions;

(e) complete payment details and finally submit your entry;

(f) you will be notified once your entry has been received.

To enter an Instant Win Competition;

(g) go to the Website and select the number of entries you wish; then

(h) follow the checkout process and submit the online entry form as above;

(i) complete the payment to receive your ticket;

(j) you will then be taken to a page where your tickets will be run against the winning ticket numbers (ticket numbers will be visible on the screen) to see if you have won.

3.10
To enter the Competition for free through Postal Route:

(a) send a completed entry form, which can be found on the Competition Website by prepaid first or second-class post to Victri Ltd, Generator Hub, The Gallery, Kings Wharf, The Quay, Exeter, Devon EX2 4AN by the Closing Date;

(b) include the following information: full name, address, telephone number, email address and any other information outlined in the Competition form;

(c) you must provide answers to all Competition Questions provided.

All required information specified on the Competition form must be completed to be eligible to enter and win.

3.11
Promoter will not accept hand delivered entries and any incomplete or illegible entries may be disqualified
3.12
All entries must be in English language and there is no charge to register for use of the website. All Entrants information must match the account details.
3.13
The Promoter will not accept:

(a) responsibility for Competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind;

(b) proof of posting or transmission as proof of receipt of entry to the Competition;

3.14
The maximum number of entries to a Competition will be stated on the Website. If an Entrant exceeds the entry limit for a Competition, all entries received over the limit (in order of receipt) will be void and ineligible to win.
3.15
Each free entry must be submitted and posted to the Promoter separately. Bulk entries in one envelope will not be accepted as multiple entries. Promoter reserves the right at its discretion to treat a bulk entry if received as one single entry.
3.16
All entries must be submitted by the individual Entrant to be valid. Use of multiple addresses, including email addresses, identities, logins, devices, or any other tactics used in an effort to receive entries over an entry limit is prohibited and will void any entry from the Entrant which may lead to disqualification.
3.17
The Promoter will not accept Competition entries that are: automatically generated by computer or created by artificial intelligence (including but not limited to chatbots such as ChatGPT or similar software applications); completed by third parties; illegible, have been altered, reconstructed, forged or tampered with; photocopies and not originals; or incomplete.
3.18
You must have created an account on the Website for free entry to be processed. Postal entries received without a registered account may not be processed. All information on the postal application must correspond to the information on the account.
3.19
Postal entry does not guarantee entry into a draw if it does not reach the Promoter before the Closing Date specified or if it gets lost.
3.20
Please note that, Promoter must receive your entries 24 hours before Closing Date of the Competition. Entries not received 24 hours before the Closing Date will not be entered into the next like for like draw.
3.21
Where a competition is priced at a lesser value than postage, multiple entries will be credited for each postal entry up to the value of second class postage.
3.22
The system for allocating prizes does not discriminate between the two entry routes.

4.

Winner Drawing

4.1
Entrants who are confirmed and verified as eligible to win, will be referred to individually as “Winner” and collectively as “Winners”.

Draw Competitions

4.2
Winner(s) will be selected using a verifiably random process from among all qualified entries received. All Entrants who correctly answer the Competition Question will be entered into the random draw. The random draw will take place after the Closing Date as specified on the Promoter’s website (“Draw Date”), usually within seven days of the Closing Date. If, however, all tickets are sold before the Closing Date then the draw will be within 7 days from when all tickets have sold.

Instant Win Competitions

4.3
Entrants who correctly answer Competition questions will be entered for Instant Win Competition. Entrants will be randomly allocated a number from a spreadsheet. The Entrant number that matches a prize becomes a winner of the prize.
4.4
Online Entrants will be informed upon submission. Entrants that participated for free will be randomly allocated a number upon receipt of their entries. Winner(s) will be notified via email provided by them upon entry into the Instant Win Competition. Please note that only winners will be notified and odds of winning depend on the number of eligible entries received during the Competition entry dates.
4.5
Promoter is required by law to publish or otherwise make available information which indicates that a valid award has taken place. Names and ticket numbers will be published during live draws. If you object to any of your information being published or otherwise made available, please contact Promoter by post at Victri Ltd, Generator Hub, The Gallery, Kings Wharf, The Quay, Exeter, Devon EX2 4AN, or by email to [email protected] Please note that Promoter is still required to provide such information and winning entries to the Advertising Standards Authority on their request.
4.6
Promoter may also require winners to participate in any reasonable publicity or feature on Website and other such promotional publications
5.

Eligibility

5.1
The Competition is only open to all residents in the UK aged 18 years or over, except:

(a) employees of the Promoter or its holding or subsidiary companies;

(b) employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the Competition or its administration; or

(c) members of the immediate families or households of (a) and (b) above.

5.2
In entering the Competition, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the Competition.
5.3
The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize Competition.
6.

ENTRANT/WINNER DISQUALIFICATION

6.1
An Entrant or Winner may be ineligible to participate or receive prize(s) and/or disqualified for any of the following reasons: the commission of fraud (actual or apparent) including fraudulent misrepresentation and fraudulent concealment; failure to keep to these Terms and Conditions and other rules applicable to the Competition; failure to provide details required at the time of entering into the Competition; not responding to notification(s) or other correspondence from Promoter within the time specified in the Terms and Conditions or specific Competition rules; Promoter is unable to locate or contact an Entrant or Winner within reasonable time having made all reasonable attempts to do so; being rude, abusive, or threatening to the Promoter or any of its employees; where identity or documentation cannot be verified; failure or inability to timely accept the prize; where it has become illegal to promote the Competition or due to circumstances beyond the Promoters control including, but not limited to natural disaster, act of war or terrorism, riot, pandemic, labour condition, governmental action, and Internet disturbance; and where an Entrant or Winner has been found to have published or is publishing or entering illegal comments or inappropriate or offensive comments on Promoter’s social media pages including TikTok, YouTube, Instagram and Facebook.
6.2
Any Competition entries entered by an ineligible or disqualified Entrant or Winner or Entrant/Winner subsequently identified as not being eligible after entry will be declared void, no refunds will be given. The Entrant or Winner may be prevented from participating in any future Competitions.
6.3
If it is resolved that a Winner or potential Winner is not eligible and/or is disqualified for any reason, an alternate winner or potential Winner will be selected using a verifiably random process from all remaining eligible entries. The Promoter shall repeat the process until a new winner is declared and Prize(s) is awarded.
7.

The prize

7.1
The details of prize to be won regarding any Competition will be available on the website and any information on the prize are as it is to the best of the Promoter’s knowledge, information and belief at the time it is published without any representations or warranties as to value, condition or any other information provided on the Website.
7.2
Non-cash Prizes are subject to availability. The Promoter reserves the right in its sole discretion to substitute the prize with a prize of comparable or greater value or cash. Any such change will be duly communicated on the website or Competition page.
7.3
A product's true colour may not exactly match that shown on your device or in our marketing materials or its packaging may be slightly different.
7.4
The Winner is solely responsible (unless otherwise stated), for any applicable taxes, fees and expenses related to acceptance, ownership and use of a Prize. Once the Winner has accepted the prize, Promoter will not replace any lost or stolen Prize.
7.5
Should a winner decide to reject a prize or some part of a prize such prize will be deemed forfeited. Promoter shall have no obligation to award the rejected or unclaimed portion of any Prize(s) to an alternative winner.
7.6
Some types of Prizes may have other restrictions or limitations which may include third party retailer/ rewards programme operator, these will be published on the website where applicable. Please note that Winners maybe required to create an account to access certain prizes.
7.7
Where prize is a holiday or an event:

(a) Winner and companion (if applicable) must travel or attend event(s)on the dates and itinerary specified unless flexibility is stated on the prize.

(b) The prize will usually indicate the standard of ticket and transportation to destination.

(c) Once tickets have been issued it shall be at the sole discretion of the Promoter to replace the ticket should you lose or misplace them.

(d) The prize does not include travel insurance, the cost of transfers to and from airports or stations, food and drink, spending money, tax or personal expenses. Any other costs incurred in addition to those set out above and that are incidental to the fulfilment of the prize are the responsibility of the Winner(s).

(e) If for any reason beyond the Promoter’s control the event is delayed or rescheduled, tickets for the delayed or rescheduled event may be provided at the reasonable discretion of Promoter.

(f) In the event of a cancellation, the remainder of the Prize, if any, will be awarded without the scheduled event or the Promoter may at its sole discretion provide alternative Prize of equal or greater value.

(g) You will be responsible for ensuring that you and any person travelling with you (if applicable) are available to travel and hold valid passports, any necessary visas and travel documents for the holiday in question on the travel dates specified.

7.8
Where prize is a vehicle:

(a) The Promoter, or any of its partners including suppliers are not giving any warranty, representation, or guarantee, express or implied, in fact, or law, to the Prize vehicle, including but not limited to its quality, mechanical condition or fitness (other than those which cannot be excluded by applicable law).

(b) Promoter reserves the right to substitute a similar vehicle of equal or greater value should the vehicle as described be unavailable for any reason beyond its reasonable control

(c) Prize vehicle would come with a valid MOT unless stated in the Competition. Winner is however responsible for any insurance, Vehicle/road tax, fuel, vehicle maintenance and all other fees and expenses associated with the receipt and use of the vehicle.

(d) The Winner may be required to show proof of valid insurance, road tax and driver’s licence on taking delivery.

7.9
Prizes are subject to availability. The Promoter may at its sole discretion provide cash alternatives to the prize. This will be published on the Competition webpage if applicable. There is no cash alternative for the Prize unless stated.
7.10
The prize is not negotiable or transferable.
8.

Winners

8.1
The decision of the Promoter is final and no correspondence or discussion will be entered into.
8.2
The Promoter will contact the winner personally as soon as practicable after the announcement date, using the contact details provided by the winner.

Draw based Competition

8.3
Winner will be contacted within 7 days from the Draw Date. Winner is expected to respond within 14 days from the Draw Date. Failure to acknowledge notification may lead to forfeiture of the prize and/or disqualification. The Promoter reserves the right to re-run the process.

Instant Win Competition

8.4
Once payment is made and Competition is entered Entrants will be notified whether they won or not. Winners via the free entry route will be contacted no later than 48 hours from the date on which their entry was received. Where the winner fails to acknowledge notification or fails to claim the Prize within 14 days of the Promoter's first attempt to contact the Winner, the Promoter reserves the right to put the Prize back to the pool for that Competition or discontinue with the Prize as it deems fit.
8.5
If you object to any or all of your surname, county and winning entry being published or made available, please contact the Promoter at [email protected]
9.

Claiming the prize

9.1
The details of how to claim the prize or receive delivery will be made available on the website. The prize may not be claimed by a third party on your behalf.
9.2
Cash Prize(s) where applicable will be transferred directly to the Winner's nominated bank account. The winner will undergo a verification process by providing necessary documentation to show that a particular bank account belongs to the Winner or jointly owned with a third-party beneficiary. Failure to do so within the stipulated time would result in a disqualification and/or forfeiture of the prize.
9.3
The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize within 14 of days of the Draw Date, the Promoter reserves the right to offer the prize to another winner following a successfully re-run of the process.
9.4
The Promoter does not accept any responsibility if you are not able to take up the prize.
10.

Limitation of liability and Release

10.1
Nothing in these Terms and Conditions limits or excludes your legal rights as a consumer.
10.2
Insofar as is permitted by law, the Promoter, its agents, suppliers, distributors and any advertising platform used in connection with the promotion of any Competition, including but not limited to Facebook, Google LLC, Instagram, YouTube, Inc., Twitter, Inc., and any of their respective parents, subsidiaries and affiliates will not in any circumstances be responsible or liable to compensate the Winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize. Your statutory rights are not affected.
11.

Data protection and publicity

11.1
The Promoter will only process your personal information as set out in the privacy policy See also Clause 4 and Clause 8 with regard to the announcement of winners. If you object to any of your information being published or otherwise made available, please contact Promoter by post at Victri Ltd, Generator Hub, The Gallery, Kings Wharf, The Quay, Exeter, Devon EX2 4AN , or by email at [email protected] Please note that Promoter is still required to provide such information and winning entries to the Advertising Standards Authority on their request.
11.2
You have the right to request that Promoter does not contact you by any of the means provided on the Website under the Data Protection Act. Please note that making this request will be considered as a withdrawal from the Competition as there may be no other way to contact you. Fees received will be refunded accordingly. 12.

General

12.1
If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the Competition.
12.2
The Promoter reserves the right to hold void, suspend, cancel, or amend the prize Competition where it becomes necessary to do so.
12.3
These terms and conditions are governed by English law. If any entrants to this promotion wish to take court proceedings, then they must do this within the courts in the United Kingdom.
